1. Acceptance of Terms

By accessing our website or placing an order with Divine Flavours, you agree to be bound by the terms and conditions set forth below. If you do not agree to these terms, please do not use this website or our services.

2. Products and Services

We offer freshly prepared meals, beverages, desserts, and catering services inspired by Virgin Islands and Dominican Republic cuisine. All items are subject to availability and may change without prior notice.

3. Ordering & Payment

• Orders must be placed through our official channels (website, mobile app, phone, or in person).
• All payments must be made at the time of ordering unless otherwise agreed.
• We accept credit/debit cards, cash and ATH movil.

4. Cancellations & Refunds

• Same-day cancellations may not be eligible for a refund.
• Refunds will be issued only for orders cancelled 24 hours or more in advance, subject to management approval.
• No refunds will be issued for missed pickups or delivery unless due to an error on our part.

5. Meal Plan Subscriptions

• Meal plan subscriptions are billed weekly or monthly, depending on the chosen plan.
• Cancellation Policy: Meal plan cancellations require 48 hours’ notice before the next delivery cycle to avoid charges.
• Adjustments: Customers may request menu adjustments (e.g., dietary preferences), but availability cannot be guaranteed.
• Missed or skipped days are non-refundable, unless due to an error on our part.

6. Event Catering Deposits and Bookings

• A 50% deposit is required to confirm all catering bookings.
• Deposits are non-refundable if cancelled within 7 days of the event.
• The remaining balance must be paid in full 48 hours before the event.
• Major changes to catering orders (menu or quantity) must be confirmed at least 5 days prior to the event date.

5. Delivery & Pickup

• Deliveries are offered in select areas of Tortola and subject to a delivery fee.
• Please ensure someone is available to receive the order at the specified location and time.
• Divine Flavours is not liable for delays due to incorrect addresses or unforeseen circumstances.

6. Allergies & Dietary Restrictions

We prepare food in a shared environment. While we strive to accommodate dietary needs, we cannot guarantee the absence of allergens such as nuts, dairy, gluten, etc. Please inform us of any allergies when ordering.

7. Intellectual Property

All website content, branding, and images are the property of Divine Flavours. You may not reproduce, duplicate, or exploit any portion of the site or our products without written permission.

8. Privacy Policy

We respect your privacy. Any personal information you provide will only be used to fulfill your orders and communicate with you regarding our services. We do not sell or share your information with third parties.

9. Modifications to Service

Divine Flavours reserves the right to change menu items, prices, service areas, or these terms at any time. Changes will be posted on our website.

10. Weather & Force Majeure

Divine Flavours shall not be held liable for any failure to perform or delay in service due to weather conditions, natural disasters, or any circumstances beyond our reasonable control (including but not limited to storms, hurricanes, floods, fires, or acts of God).

If weather conditions prevent delivery or execution of a scheduled event, we will work with the customer to reschedule or arrange alternate service, but no refunds will be issued for cancellations due to inclement weather unless agreed upon in writing.
